Overview

Welcome to Fika. In these terms, "we", "us" and "our" mean Fika Trading Ltd (company number 14155834), trading as Fika, whose registered office is 77 Greenways, Over Kellet, Carnforth, LA6 1DE. We operate this website and online store, including all related information, content, features, tools, products and services (the "Services"). Our store is powered by Shopify.

These Terms of Service, together with the policies they refer to (including our Shipping Policy, Refund Policy and Privacy Policy), set out your rights and responsibilities when you use the Services. Please read them carefully. By visiting, interacting with or using the Services, you agree to be bound by them. If you do not agree, please do not use the Services.

Nothing in these terms affects your statutory rights as a consumer.

1. Access and account

You must be at least 18 years old to place an order. To use the Services, including purchasing products, you may be asked for information such as your email address, billing, payment and delivery details. You confirm that the information you provide is correct, current and complete.

If you create an account, you are responsible for keeping your login details secure and for all activity on your account. You may not transfer, sell or license your account to anyone else.

2. Our products

We make every effort to describe and show our products accurately. However, colours and appearance may vary from how they look on your screen because of your device and its settings. Product descriptions and availability may change from time to time. We may discontinue a product at any time and may limit the quantity of any product that we sell.

3. Orders

When you place an order, you are making an offer to buy. Your order is accepted when we send you an order confirmation email, and we must receive and process your payment first. We may decline or cancel an order, for example if a product is unavailable, if there is an error in the price or description, or if we suspect fraud. If we do, we will contact you using the details you gave us and refund any payment you have made.

Your right to cancel, return or exchange an order is set out in our Refund Policy. You confirm that your purchases are for your own personal use and not for resale.

4. Prices and payment

Prices are shown in pounds sterling (GBP) and include VAT where applicable. Delivery costs are shown at checkout before you pay. Prices, discounts and promotions may change without notice, but the price you pay is the price shown when you place your order, as confirmed in your order confirmation email. If a promotion has its own terms, those terms apply to that promotion.

You confirm that the payment details you provide are correct and that you are authorised to use the payment method.

5. Shipping and delivery

We deliver to addresses within the United Kingdom. Delivery times are estimates and are not guaranteed. Full details are in our Shipping Policy. We are not responsible for delays caused by carriers or by events outside our reasonable control. Risk in the products passes to you when they are delivered to you.

6. Salon appointments

Salon appointments are booked and managed through Fresha. When you book through Fresha, the Fresha terms of service also apply, and Fresha handles your booking information under its own privacy notice.

7. Intellectual property

The Services, including all text, images, graphics, logos, video and design, are owned by Fika Trading Ltd or our licensors and are protected by copyright, trademark and other intellectual property laws. You may use the Services for your own personal, non-commercial use only. You must not copy, reproduce, distribute, modify or republish any part of the Services without our written permission.

Fika's names and logos are our trademarks. Authentic Beauty Concept and other brand names shown on this site belong to their respective owners.

8. Third-party tools and links

The Services may include tools or links provided by third parties. We do not control them and are not responsible for their content, accuracy or privacy practices. If you use them, you do so at your own risk and should read their terms and policies.

9. Our relationship with Shopify

Fika is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Fika. Shopify is not responsible for any aspect of those sales, including any injury, damage or loss resulting from products you purchase, to the extent permitted by law.

10. Privacy

Our Privacy Policy explains how we collect and use your personal information. Because the Services are hosted by Shopify, Shopify also processes some personal information, as described in the Shopify Consumer Privacy Policy. By using the Services, you acknowledge that you have read these policies.

11. Feedback and reviews

If you send us ideas, suggestions or reviews ("Feedback"), you give us a free, worldwide, non-exclusive licence to use, reproduce, publish and display that Feedback for any purpose, including marketing. You confirm that your Feedback is your own, is honest, does not infringe anyone's rights and does not contain anything unlawful, abusive or harmful. We may edit or remove Feedback at our discretion.

12. Errors and omissions

Occasionally the Services may contain errors, such as in product descriptions, pricing, delivery information or availability. We may correct any error and, where an order was affected by a genuine error, cancel it and refund you in full.

13. Prohibited uses

You may use the Services for lawful purposes only. You must not use them to break any law, infringe anyone's rights, harass or harm others, send spam, upload viruses or other malicious code, or provide false or misleading information. You must not scrape or copy the Services using automated tools, or try to bypass or interfere with our security or access controls. We may suspend or end your access if you break these terms.

14. Automated agents

If you use, or allow the use of, any software or service that takes autonomous or semi-autonomous action on your behalf to access the Services (an "Agent"), the following applies. An Agent must identify itself in every request by including "Agent/[agent name]" in its user agent string, must not hide that it is an Agent (including by mimicking human behaviour or bypassing CAPTCHAs), must answer truthfully if asked whether it is a human or a computer, and must not bypass any measure we use to limit or control Agent access. We may limit or block Agent access by technical means, and no Agent may access the Services if we have asked it not to.

15. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law, and it does not affect your statutory rights as a consumer, including your rights if products are faulty, not as described or not of satisfactory quality.

Subject to that, the information on the Services is provided for general information only. We are not liable for any loss or damage that was not a reasonably foreseeable result of our breach of these terms, or for any business losses, as the Services are for personal use only. Our total liability to you for any order will not exceed the price you paid for that order.

16. Ending access

We may suspend or end your access to the Services at any time if you break these terms. Sections that by their nature should continue after that point (such as intellectual property, feedback, liability and governing law) will continue to apply.

17. General

If any part of these terms is found to be unlawful or unenforceable, the rest will remain in effect. If we do not enforce a right straight away, it does not mean we have given it up. These terms, together with our policies, are the entire agreement between you and us about your use of the Services. You may not transfer your rights or obligations under these terms without our written consent. The headings are for convenience only.

18. Governing law

These terms, and any dispute arising out of them or your use of the Services, are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, but if you live in Scotland or Northern Ireland you may also bring proceedings in the courts there.

19. Changes to these terms

We may update these terms from time to time by posting the new version on our website. The version in force when you place an order applies to that order. Please check this page regularly. By continuing to use the Services after a change, you accept the updated terms.
